CNN Interviews Lask on U.S. Supreme Court Strip Search Case
8-31-11 CNN's Washington D.C. Bureau Senior Producer William Mears and Correspondent Kate Bolduan interviewed Susan Chana Lask today about her prison strip search case Albert Florence v. Board of Chosen Freeholders, et al.
The U.S. Supreme court granted cert on April 4, 2011 and argument is on October 12, 2011. The issue before the United States Supreme Court is whether the Fourth Amendment permits a jail to conduct a suspicionless strip search whenever an individual is arrested for minor offenses such as violating a dog leash law or failure to pay a court fine, that are not crimes. The CNN interview should air around October 11, 2011.
In the interview Ms. Lask explains our rights under the constitution, what she hopes the U.S. Supreme Court Justices will take home from this case after hearing argument and what went wrong at the prisons that led to her taking this to the Supreme Court. Albert Florence also explains his 6 day nightmare of being hauled to prisons on an invalid warrant leading to his being strip searched twice in two prisons. The warrant was for a non-criminal offense claiming he failed to pay a court fine. In fact, he paid the fine years before and had proof of payment. The proof was ignored and he was strip searched twice in two prisons, once in a group of men.
In 2005 Ms. Lask filed the case for her client Albert Florence in New Jersey Federal District Court and won summary judgment against the prisons. The Third Circuit reversed in 2010, but Ms. Lask honored her promise to her client of 6 years to take this all the way the Supreme Court, and she did!
