Essex, Burlington Jails Liable For Strip Searches

NEWARK, N.J. – Thousands of strip searches conducted at jails in Burlington and Essex counties have been ruled unconstitutional. A federal judge in Newark, who found the jails liable for damages, says that searches of people arrested for minor offenses such as traffic tickets violated their Fourth Amendment rights. The searches occurred at the Burlington County Jail and Essex County Correctional Facility since 2003. Plaintiffs attorney Susan Chana Lask says approximately 10,000 people were subjected to the searches. Lask says she plans to file a motion for a jury trial to determine damages that could reach into the millions of dollars. Attorneys representing both counties did not immediately return phone messages Wednesday.
